Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fluxpool.ai, including our website, API, playground, and all related services (collectively, the "Service"). Fluxpool.ai is operated by [Fluxpool Legal Entity Name] ("Fluxpool," "we," "us," or "our").

By creating an account, accessing the API, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

1. Definitions

In these Terms, the following definitions apply:

  • •"Account" means your registered Fluxpool.ai user account.
  • •"API" means the Fluxpool application programming interface available at api.fluxpool.ai.
  • •"API Key" means the authentication credential issued to you for API access.
  • •"Content" means any images, videos, or other media generated through the Service using your prompts.
  • •"Credits" means the units of value used to pay for generations on the Service, purchased or granted as part of a free tier.
  • •"Generation" means a single request to create an image or video through the Service.
  • •"Model" means a third-party AI model made available through the Service (e.g., Flux 1.1 Pro, Qwen Image, Wan Video 2.1, etc.).
  • •"Playground" means the browser-based generation interface at fluxpool.ai/playground.
  • •"Prompt" means the text, image, or other input you provide to generate Content.
  • •"Service" means the Fluxpool.ai website, API, Playground, documentation, and all related services and tools.

2. Eligibility

2.1 You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Service.

2.2 You must not be a person barred from using the Service under the laws of your jurisdiction or any applicable jurisdiction, including the jurisdiction in which Fluxpool is incorporated.

2.3 If you are using the Service on behalf of an entity (company, organization, studio, etc.), you represent that you have the legal authority to bind that entity to these Terms.

3. Account Registration

3.1 To use the Service beyond browsing the public website, you must create an Account by providing a valid email address or authenticating via a supported third-party provider (Google, GitHub).

3.2 You are responsible for maintaining the confidentiality of your Account credentials and API Keys. You are responsible for all activity that occurs under your Account.

3.3 You must provide accurate, current information during registration. You must not create an Account using false or misleading information, or create multiple Accounts to abuse free tier credits.

3.4 You must notify us immediately at support@fluxpool.ai if you become aware of any unauthorized use of your Account or API Key.

3.5 We reserve the right to suspend or terminate Accounts that violate these Terms, at our sole discretion.

4. The Service

4.1 Fluxpool.ai provides a unified API and Playground interface for generating images and videos using third-party AI models. We aggregate access to multiple models through a single endpoint and credit system.

4.2 The Service includes:

  • •The Playground (browser-based generation interface)
  • •The API (programmatic access to generation models)
  • •The Models Hub (model catalog and documentation)
  • •Account management and billing dashboard
  • •Documentation and developer resources

4.3 The specific models available, their capabilities, pricing, and performance characteristics may change at any time. We will make reasonable efforts to communicate significant changes via our Changelog and, where appropriate, email notification.

4.4 The Service is provided on an "as available" basis. We do not guarantee that any specific model will remain available indefinitely. See Section 11 (Availability & SLAs) for details.

5. Credits, Pricing & Payments

5.1 Credit System. The Service uses a credit-based pricing model. Each Generation consumes credits from your Account balance. The credit cost per Generation varies by model, resolution, and other parameters. Current pricing is displayed on our Pricing page and within the Playground.

5.2 Purchasing Credits. You may purchase credits through the billing dashboard. Credit packages are available at the prices listed on our Pricing page. All prices are in United States Dollars (USD) unless otherwise stated.

5.3 Payment Processing. Payments are processed by our third-party payment processor. By purchasing credits, you agree to the payment processor's terms of service. We do not store your full payment card details.

5.4 Credit Expiry. Purchased credits do not expire. Free tier credits (see Section 6) may expire 90 days after account creation if unused.

5.5 No Refunds. Credit purchases are non-refundable except where required by applicable law. If a Generation fails due to a platform error (not a model limitation), the credits consumed will be refunded to your Account balance automatically.

5.6 Failed Generations. If a Generation fails due to a system error on our side, the credits for that Generation will be returned to your balance. Generations that complete but produce results you are unsatisfied with are not eligible for credit refunds — variation in output quality is inherent to AI generation.

5.7 Price Changes. We may change credit pricing or per-model costs at any time. Price changes apply to future purchases and Generations only. We will provide at least 14 days' notice of pricing changes via email and/or the Changelog. Your existing credit balance is not affected by price changes.

5.8 Taxes. Prices are exclusive of applicable taxes (VAT, GST, sales tax, withholding tax, etc.) unless stated otherwise. You are responsible for any taxes applicable to your purchase based on your jurisdiction.

6. Free Tier

6.1 New Accounts receive a one-time grant of free credits (the "Free Tier"). The current Free Tier allocation is listed on our Pricing page.

6.2 Free Tier credits are subject to the following restrictions:

  • •Limited to one grant per person or entity. Creating multiple Accounts to obtain additional free credits is a violation of these Terms.
  • •Free Tier credits may expire 90 days from the date of Account creation.
  • •Free Tier credits may be subject to additional rate limits or model restrictions compared to purchased credits.

6.3 We reserve the right to modify or discontinue the Free Tier at any time without notice.

7. API Usage

7.1 API Keys. Upon account creation, you may generate API Keys to access the Service programmatically. You are responsible for the security of your API Keys. Do not share API Keys publicly, commit them to public repositories, or embed them in client-side code.

7.2 Rate Limits. API usage is subject to rate limits, which may vary by account tier. Current rate limits are documented in our API Documentation. Exceeding rate limits will result in temporary request throttling (HTTP 429 responses).

7.3 OpenAI Compatibility. The API is designed to be compatible with the OpenAI API format. However, we do not guarantee full compatibility with every OpenAI SDK feature or version. The API behavior is defined by our own API Reference.

7.4 Prohibited API Usage. You must not:

  • •Attempt to reverse-engineer, decompile, or extract model weights through the API
  • •Use the API to build a competing model aggregation or API wrapper service without our written consent
  • •Resell API access without an explicit reseller agreement
  • •Circumvent rate limits, authentication, or other security measures
  • •Send intentionally malformed requests designed to exploit or disrupt the Service

7.5 Webhooks. If you use webhook endpoints to receive asynchronous generation results, you are responsible for the availability and security of your webhook endpoints. We are not liable for failed deliveries to your endpoints.

8. Content Ownership & Licenses

8.1 Your Prompts. You retain ownership of the Prompts you submit to the Service. By submitting a Prompt, you grant Fluxpool a non-exclusive, worldwide, royalty-free license to process the Prompt solely for the purpose of generating Content and improving the Service.

8.2 Generated Content. Subject to the terms of the underlying Model providers (see Section 10), you own the Content generated through the Service using your Prompts, to the extent permitted by applicable law.

8.3 License to Display. By generating Content through the Service, you grant Fluxpool a non-exclusive, royalty-free license to display your generated Content (with or without your associated Prompt) in our gallery, marketing materials, social media, and documentation — unless you opt out. You may opt out of gallery display at any time through your Account settings or by contacting support@fluxpool.ai.

8.4 No Guarantees of Uniqueness or Non-Infringement. AI-generated Content may resemble existing works, other users' outputs, or training data. We do not guarantee that Content is unique, original, or non-infringing. You are solely responsible for evaluating Content before commercial use and ensuring it does not infringe third-party rights.

8.5 Model-Specific Terms. Some underlying Model providers impose additional terms on generated Content (e.g., attribution requirements, commercial use restrictions, or content licenses). See Section 10 for details. It is your responsibility to review and comply with applicable Model-specific terms.

9. Acceptable Use

9.1 Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference.

9.2 In summary, you must not use the Service to generate:

  • •Content depicting child sexual abuse material (CSAM) — zero tolerance
  • •Non-consensual intimate imagery of real persons (deepfakes)
  • •Content designed to harass, threaten, or intimidate specific individuals
  • •Content that violates applicable laws in your jurisdiction
  • •Fraudulent or deceptive content intended to mislead (e.g., fake evidence, fake identity documents)
  • •Content that infringes copyrights, trademarks, or other intellectual property rights of third parties

9.3 We employ automated and manual content moderation. We may review Prompts and generated Content to enforce our Acceptable Use Policy. Violations may result in Content removal, Account suspension, or permanent termination, with or without prior notice.

9.4 We may report illegal Content or activity to relevant law enforcement authorities.

10. Third-Party Models & Providers

10.1 The Service provides access to AI models developed and maintained by third-party providers (e.g., Black Forest Labs, Alibaba/Qwen, Kuaishou, Tencent, Runway, Stability AI, and others). Fluxpool does not develop or train these models.

10.2 Each Model may be subject to its own license terms, acceptable use policies, and content restrictions imposed by the Model provider. These terms are in addition to Fluxpool's Terms. Where a Model provider's terms conflict with these Terms, the more restrictive provision applies.

10.3 We make reasonable efforts to surface relevant Model-specific terms on individual Model pages. However, it is your responsibility to review and comply with the applicable Model provider's terms.

10.4 Fluxpool does not warrant or guarantee the accuracy, quality, reliability, or fitness for any particular purpose of any third-party Model's output. Model capabilities, availability, and behavior are controlled by the respective providers and may change without notice.

10.5 We are not liable for any claims arising from the output of third-party Models, including but not limited to intellectual property infringement claims, content moderation failures by the Model provider, or output quality issues.

11. Availability & SLAs

11.1 We aim to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as available" basis.

11.2 Planned maintenance will be communicated in advance via our Status page and, where possible, via email to affected users.

11.3 Individual Model availability depends on the upstream Model provider. A Model may become temporarily or permanently unavailable due to provider outages, deprecation, or changes in provider terms. We will update our Models page and Changelog accordingly.

11.4 Enterprise SLAs. Customers on Enterprise plans may negotiate custom Service Level Agreements with defined uptime commitments and remedies. Standard (non-enterprise) accounts are not covered by any uptime SLA.

12. Data & Privacy

12.1 Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12.2 Prompt & Content Data. We may temporarily store your Prompts and generated Content for the purpose of delivering results, debugging, and improving the Service. Prompt and Content data handling is described in detail in our Privacy Policy.

12.3 Third-Party Data Sharing. When you submit a Generation request, your Prompt is transmitted to the selected third-party Model provider for processing. Each Model provider has its own data processing practices. We encourage you to review the privacy policies of the Model providers whose models you use.

12.4 Data Retention. Generated Content is stored in your Account history for your convenience. You may delete your generation history at any time through your Account settings. Account deletion will result in the removal of your stored generation history, subject to any legal retention obligations.

13. Intellectual Property

13.1 The Fluxpool name, logo, website design, documentation, and proprietary software are the intellectual property of [Fluxpool Legal Entity Name] and are protected by applicable intellectual property laws.

13.2 You may not use Fluxpool's trademarks, logos, or brand assets without our prior written consent, except as necessary to truthfully identify your use of the Service (e.g., "Powered by Fluxpool" or "Built with Fluxpool.ai").

13.3 The AI models accessible through the Service are the intellectual property of their respective providers. Fluxpool does not claim ownership of any third-party Model.

13.4 Our API Documentation, code examples, and SDK code are provided under the MIT License unless otherwise stated.

14. Disclaimers

14.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

14.2 WE DO NOT WARRANT THAT:

  • •THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • •THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR NEEDS
  • •ANY CONTENT GENERATED WILL BE FREE FROM INTELLECTUAL PROPERTY CLAIMS BY THIRD PARTIES
  • •ANY SPECIFIC MODEL WILL REMAIN AVAILABLE

14.3 YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT IS PROBABILISTIC IN NATURE AND MAY PRODUCE UNEXPECTED, INACCURATE, OR UNSUITABLE RESULTS. YOU USE THE SERVICE AND ITS OUTPUTS AT YOUR OWN RISK.

15. Limitation of Liability

15.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLUXPOOL, ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • •YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE
  • •ANY CONTENT GENERATED THROUGH THE SERVICE
  • •UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS
  • •STATEMENTS OR CONDUCT OF ANY THIRD PARTY (INCLUDING MODEL PROVIDERS) ON THE SERVICE
  • •ANY OTHER MATTER RELATING TO THE SERVICE

15.2 OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FLUXPOOL IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

15.3 THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF FLUXPOOL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

15.4 SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

16. Indemnification

16.1 You agree to indemnify, defend, and hold harmless Fluxpool, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

  • •Your use of the Service
  • •Your violation of these Terms
  • •Content you generate through the Service
  • •Your violation of any third-party rights (including intellectual property rights)
  • •Your violation of applicable laws or regulations

17. Termination

17.1 By You. You may close your Account at any time through your Account settings or by contacting support@fluxpool.ai. Upon closure, your remaining credits are forfeited and non-refundable (except where required by applicable law).

17.2 By Us. We may suspend or terminate your Account at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to:

  • •Violation of these Terms or the Acceptable Use Policy
  • •Abusive, fraudulent, or illegal activity
  • •Extended inactivity (12+ months with no login or API call)
  • •Non-payment of outstanding balances

17.3 Effect of Termination. Upon termination:

  • •Your access to the Service (Playground and API) is revoked
  • •Your API Keys are invalidated
  • •Remaining credits are forfeited (non-refundable)
  • •Your generation history may be deleted after a 30-day grace period
  • •Provisions of these Terms that by their nature should survive termination (including Sections 8, 14, 15, 16, and 19) shall survive

18. Changes to These Terms

18.1 We may update these Terms from time to time. When we make material changes, we will:

  • •Update the "Last updated" date at the top of this page
  • •Notify you via email to the address associated with your Account (for material changes)
  • •Post a notice on the Service (for material changes)

18.2 Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and close your Account.

18.3 We will provide at least 30 days' notice before material changes take effect, except where changes are required to comply with legal obligations or to address security issues.

19. Governing Law & Disputes

19.1 These Terms are governed by and construed in accordance with the laws of [Governing Jurisdiction], without regard to conflict of law principles.

19.2 Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of [Arbitration Body], except that either party may seek injunctive relief in a court of competent jurisdiction.

19.3 You agree to resolve disputes on an individual basis. You waive any right to participate in a class action, collective action, or representative proceeding.

19.4 Notwithstanding the above, if you are a consumer in a jurisdiction that provides mandatory consumer protection rights that cannot be waived by contract, those rights apply to you regardless of this section.

20. General Provisions

20.1 Entire Agreement. These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Fluxpool regarding the Service.

20.2 Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

20.3 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

20.4 Assignment. You may not assign or transfer your Account or these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.

20.5 Force Majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, pandemics, internet outages, third-party provider outages, or cyberattacks.

20.6 No Agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Fluxpool.
